Terms and Conditions

  1. The promoters of 'ALLUXIA 4TH BIRTHDAY"
    (Competition) is Alluxia Pty Ltd (ACN 153 460 096) of PO Box 1070, NEW FARM, QLD 4005 (the Promoters).
  2. The Competition begins on Thursday 25 August 2016 at 5.00pm (Australian Standard Time) and ends on Thursday 15th September 2016 at midnight (Australian Standard Time) (Competition Period).
  3. Entries must be received by the Promoters during the Competition Period.
  4. The Promoters reserves the right to either allow or disallow any entrant for any reason it sees fit in their absolute discretion.
  5. Entrants can only win a maximum of one prize for the duration of the Competition Period.
  6. To enter, individuals must fill in the competition form on the alluxia.com website or the alluxia Facebook Page.
  7. This document, the instructions on how to enter the Competition and other details contained within promotional advertisements and the entry form (if applicable) form part of the Terms and Conditions. It is each entrant's responsibility to confirm their entry has been received before the end of the Competition Period.
  8. The Promoter accepts no responsibility for late, lost or misdirected entries.
  9. Entry to the Competition is not open to:
    a) persons under the age of 18 years;
    b) employees of Alluxia Propriety Limited
    c) any spouse or adult child, parent, grandparent, grandchild or sibling of the employee or of a spouse of the employee;
    d) any promotional agents (including their spouses) of Alluxia Propriety Limited;
    e) persons not resident of Australia.
  10. The Winner of the Major Prize shall be chosen by the Judges at random from entries received during the Competition Period.
  11. The Winners will be drawn and notified Friday 16 September 2016 at 0900 following Competition Period.
  12. When the Winners are notified of the Prize they will also be provided with details as to the collection of the Prize.
  13. The Judges' decision is final and no correspondence will be entered into.
  14. The Major Prize total value is $1570.
  15. The Major Prize includes Two (2) nights' accommodation in a Botanica Villa at Elements of Byron for maximum 2 people, including daily continental breakfast, sunrise yoga beachside and high-speed wi-fi. The Major Prize is subject to availability at time of booking. All extras/upgrades are payable at time of booking. Voucher is not transferable or redeemable for cash. Booking subject to black out dates 16 September - 2 October, 2016 and 9 December, 2016 and 21 January, 2017. Voucher must be presented on arrival. Valid from August 2016 - March 2017.
  16. The Major Prize also includes a $500 Styling Session at David Lawrence. *Enjoy a complimentary styling experience at David Lawrence Stand Alone stores in Australia (experience not available online, David Jones, Myer or Outlet stores). Receive clothing or accessories to the value of $500 RRP at the time of the styling experience (full price styles). This experience is not available to be in conjunction with any other offer and products claimed not refundable or could be exchange for other goods once received at the styling experience. The winner must contact David Lawrence Marketing Department or Customer Care within 7 days of winning to claim their prize via email to customercare@davidlawrence.com.au. The winner will be verified by Alluxia prior to the styling experience being arranged.
  17. The Winner must claim the Prizes on or before a month from their notification date. The Prizes must be claimed in person unless the Winners are otherwise advised. Identification, which includes a photograph, may be required. The collection of the Prizes is the sole responsibility of the Winners. The Prizes will only be awarded following winner validation and verification.
  18. In the event that a Winner fails to satisfy any of the Terms and Conditions of the Competition, that Winner shall not be entitled to the Prize and the Promoters may at their discretion award the Prize to another entrant in accordance with the Terms and Conditions or choose not to award the Prize.
  19. The Prizes must be taken as stated and are non-transferable, not exchangeable and not redeemable for cash. If the specified prize becomes unavailable for any reason, the Promoter may substitute a prize of like or equal value. Any tax payable as a result of a prize being awarded or received will be the winner's responsibility.
  20. The Promoter takes no responsibility for the loss of Prizes due to incorrect or imprecise delivery details provided by a Winner. The Promoter makes no representations or warranties as to the quality, suitability, merchantability of any of the goods or services offered as Prizes. To the extent permitted by law, the Promoter is not liable for any loss suffered or sustained to personal property and including, but not limited to consequential (including economic) loss by reason of any act or omission, deliberate or negligent, by the Promoter, or its servants or agents, in connection with the arrangement for supply, or the supply, of any goods or services by any person to the Winner and, where applicable, to any persons accompanying the Winner.
  21. The Promoter reserves the right to disqualify a Winner if the Winner has breached any of the Terms and Conditions. The Winner forgoes the Prize if their entry is misleading or if the Winner does not adhere to the Terms and Conditions.
  22. The Promoter reserves the right to:
    a) disqualify any entrant whose conduct is contrary to the spirit of the Terms and Conditions or the intention of the Competition and to declare as void any or all of their entries based on such conduct;
    b) declare as void any entries or claims for Prizes resulting from any printing, production or distribution errors or where there has been error in any aspect of the preparation for or conduct of the Competition materially affecting the result of the Competition or the number of Winners or the value of claims for Prizes;
    c) add to or to waive any of the Terms and Conditions; and
    d) cancel the Competition or any part of it at any stage in the event of circumstances beyond the Promoter's control.
  23. By entering the Competition entrants warrant that their submissions are true and accurate. Entrants agree to make themselves available at the Judges' request for audit purposes to satisfy the Judges of the claims made in the entrant's submissions. Entrants may be asked to provide further evidence to substantiate their entries and this evidence must be provided within the timeframe stipulated by the Judges.
  24. The Promoters and their related entities, employees, contractors, servants or agents shall not be liable for and accept no responsibility for any accident, loss, injury or damage to any individual or property arising out of or in conjunction with the Competition or the Prizes either during or after the Competition except for any liability which cannot be excluded by law.
  25. The Promoters are not responsible for lost, interrupted communications or unavailable network server or other connections, failed telephone, mid-delivery or computer transmissions or other errors of any kind, whether human, mechanical or electronic.
  26. The Promoters assume no responsibility for any error, defect, delay, theft or unauthorised access to or alternation of entries. Subject to any written directions given under the applicable law, if for any reason, the Competition is not capable of operating as planned, including infection by computer viruses, tampering, unauthorised intervention, fraud or any other causes beyond the control of the Promoters which corrupts or affects the administration, security, fairness, or proper conduct of the Competition, then the Promoters reserves the right, at their sole discretion, to cancel, terminate, modify or suspend the Competition. The Promoters reserves the right, in their sole discretion, to disqualify any individual for:
    a) tampering with the entry process, including exceeding any limitation on the numbers of entries, or any other process as determined by the Promoter that in any way affects the fairness of the promotion;
    b) tampering with the operation of the Competition or the web site of the Promoters;
    c) acting in violation of the Terms and Conditions; or
    d) acting in an unsportsmanlike or disruptive manner.
  27. Participation in the Competition constitutes the entrant's unconditional agreement to and acceptance of the Terms and Conditions. The entrant is responsible for ensuring his or her familiarity with the Terms and Conditions. The Promoters' decision not to enforce a specific term or condition does not constitute a waiver of that term or condition or of the Terms and Conditions generally.
  28. All entries remain the property of the Promoters and may be entered into a database for future marketing or promotional activities. By entering the Competition entrants, in the event that they are a Winner, consent to the publishing of their names and suburb of residence on the website www.alluxia.com and Alluxia Facebook page and/or Elements of Byron Facebook page and/or David Lawrence Facebook Page. Acceptance of a Prize by a Winner constitutes permission for the Promoter to use the Winner's name, suburb of residence, recording of the Winner's voice and likeness for advertising and promotional purposes without compensation, unless otherwise prohibited by law. The Promoter will not use the entrants' personal information for any other purpose without their consent unless required or authorised to do so by law. Entrants must notify the Promoter in writing if they would like to amend their personal information or if they have any queries as to how their personal information will be used.

  30. Entry and continued participation in the promotion is dependent on entrants following and acting in accordance with the Facebook Statement of Rights and Responsibilities, which can be viewed at www.facebook.com/terms.php
  31. This promotion is in no way sponsored, endorsed or administered by, or associated with, Facebook. Entrants are providing their information to the Promoter and not to Facebook. The information an entrant provides will only be used for the purposes outlined in these Terms and Conditions. Any questions, comments or complaints about this promotion must be directed to the Promoter and not to Facebook. Facebook will not be liable for any loss or damage or personal injury which is suffered or sustained by an entrant, as a result of participating in the promotion (including taking/use of a prize), except for any liability which cannot be excluded by law.
  32. Elements of Byron and David Lawrence is not a sponsor of this promotion.
